LGBT associations lodge complaints against France before the European Commission
Stop Homophobia, Mousse, Local AIDS Elves and LGBT Families filed a complaint.
They protest against the obligation for gay men to observe a twelve-month period of abstinence to be allowed to donate blood. Several LGBT associations announced Thursday, June 20 to have filed a complaint against France before the European Commission for discrimination. "This regulation, still in effect, effectively excludes 93.8% of gays from blood donation", say in a joint statement Stop Homophobia, Foam, Local Elected Against AIDS and LGBT Families.
Through this complaint, the associations, which had been dismissed by the State Council in 2017, hope that the French distinction based on the sexual behavior of donors is recognized as unlawful discrimination on the grounds of sexual orientation.
In France, since the blood donation reform of July 2016, homosexuals can donate blood after twelve months of abstinence. Previously, they had been totally excluded from blood donation since 1983 because of the risk of transmission of the AIDS virus. This rule "creates legal uncertainty for LGBT + people because it makes discrimination based on sexual behavior possible", believes Etienne Deshoulières, lawyer associations.
