Transplant doctors describe the situation as dramatic. The number of organ donations in Germany is falling. The need for organs is much greater. And every single case is a destiny. This includes the reliance on medical machines or the gradual extinction of life. Every year more than 1000 people die in Germany because there was no donor organ for them. At the European level, Germany imports significantly more donor organs than it supplies to patients in other countries.

There are many reasons for this dilemma. This certainly includes scandals in the field of organ donation, which have been publicized in recent years and have weakened confidence in current practice. This also includes upheavals in the increasingly detailed regulated hospital landscape in Germany and its increasing commercialization. Many homes complain about a lack of funding and human resources to be prepared to provide organ donation. But more money for a medical border area – this is the parliament as legislators as well as the health insurance tends to be annoying.

A question that touches primal fears and basic beliefs

But all these objections do not help in a question that touches emotions, hopes or fears, and sometimes religious beliefs. For organ donation – this is one of the very sensitive issues that a parliament has to decide. Whenever the Bundestag has to advise and decide on such a question – whether it is euthanasia, abortion, stem cell research or just organ donation – then the dispute changes. The speeches are serious, in principle, again and again with a reference to the constitution.

That's good. Even if the term "great hour" forbids in the face of a much too empty parliamentary plenary. Such debates show that the Bundestag is not simply made up of factions and certainly not of command recipients of the governing parties, but of individual MPs: 709 individual MPs who have to make a personal decision. Until then, there are two bills competing, each being promoted by members of various political groups. For a "contradiction solution" advertised from the beginning of the Christian Democratic Federal Health Minister Jens Spahn. Accordingly, the medicine would have access to organs of each deceased, if there is no corresponding counter-declaration during life or by the relatives after death. This is opposed by a "consent solution" in which every deceased person must have expressly consented to organ harvesting. This is similar to today's concept, but wants to achieve higher numbers through a nationwide online register.

The number of donor organs will probably increase

It is good that in both concepts, the number of donor organs in Germany would probably increase. Gradually – because that's a long process. But given the often shattering perspectives of those affected, be it in the media, be it in the circle of acquaintances, the basic approach of the contradictory solution that takes the individual into account remains correct. It is – looking at the right of self-determination – to interfere with the freedom of the individual.

But is it too much to demand that each and every one – or, in the case of death without a previous vote, relatives – deal with this question and then decide?
